Retrospective permission following enforcement action to office outbuilding

Retrospective Planning Approval was granted for the erection of a detached outbuilding to be used as an office for a Dental Practice, with a range of conditions, several of which weren’t complied with, including the height, external materials, planting, and hours of operation. Enforcement action was commenced however following our involvement a planning application was made to regularise the situation and seek changes to the original approval.

The justification was successfully made for the various aspects, including the previous requirements not being necessary to make the scheme acceptable in planning terms, with approval granted for all aspects, including a longer working day. In addition to the more intensive use, the approval saved our client thousands of pounds worth of construction costs in remedial works as otherwise the roof would have had to have been lowered and the outbuilding reclad in brick.
