D2 Use Class is associated with assembly, leisure and entertainment use.

D2 Use Class – Assembly & Leisure

D2 Use Class is associated with assembly, leisure and entertainment use. Similar to D1 these are public buildings, however, unlike these other D class of buildings, these could be seen to be more associated with non-institutions and more unrestricted access.

Such uses, which fall within the D2 Use Class include:

  • a cinema,
  • a concert or music halls,
  • a bingo hall,
  • a dance hall (but not nightclub)
  • a swimming bath, skating rink, gymnasium or area for other indoor or outdoor sports or recreations (not involving motorised vehicles or firearms).

What doesn’t fall with a D2 Use Class?

There are certain uses that one may expect to fall within a D2 Use Class, such as Nightclubs, Casinos and Theatres, however, such uses are classed as Sui Generis.

D2 Use Class – Changes in use

For changes of use to (or from), a D2 Use Class planning permission will likely be required, via a full planning application.

Confirmation from your Local Planning Authority should be sought prior to any change of use being undertaken.

The nature of a D2 Use Class building can vary greatly with issues such as hours of operation, noise, disturbance, parking and servicing requirements, highways issues among others being often key considerations.

The location of such D2 Use Class buildings also varies greatly depending upon the nature of the individual operators, including Town Centres, edge of town centres and other locations however the often-conflicting nature of ease of access and sustainable planning policies can make obtaining such planning permission difficult.

England - D2 Use Class

In England, from 1st September 2020, changes were made to the Use Classes Order. All “D” classes are now revoked, with the previous D2 Use, generally incorporated within Class F2 (local community), although certain uses including Cinemas, concert halls, bingo halls, live music venues and dance halls are now Sui Generis.

Northern Ireland and Wales - D2 Use Class

This use class is applicable in Wales and Northern Ireland although the specific allowable inclusions or exclusions, as well as allowable permitted development changes of use, may vary from those stated above.

Scotland - Class 11 - Assembly and Leisure

In Scotland, Class 1 relates to the use as a cinema; a concert hall; a bingo hall or casino; a dance hall or discotheque; or a swimming bath, skating rink, gymnasium or area for other indoor or outdoor sports or recreation, not involving motorised vehicles or firearms.
